4.10 As part of the Samsung Services, Samsung may also offer users the opportunity to participate in loyalty programs for users eligible for those programs. These loyalty programs may be subject to additional terms and conditions. Samsung may determine a user`s eligibility to participate in these programs in its sole discretion. 5.3 We have the right, but not the obligation, to monitor your use of the Samsung Services, accounts, content and communications that we determine, in our sole discretion, to violate the Samsung Services Terms of Service. We reserve the right, but have no obligation, to monitor or involve ourselves in disputes between you and other users. temporarily or permanently disable or suspend your use of the Services, including access to your user accounts and any files or other content contained in your accounts; 1.2 THE SAMSUNG SERVICES ARE NOT INTENDED AND ARE NOT INTENDED FOR CHILDREN UNDER THE AGE OF 13. IF YOU ARE UNDER THE AGE OF 13, YOU MAY NOT USE SAMSUNG SERVICES OR PROVIDE PERSONAL INFORMATION TO SAMSUNG. If you are a parent or guardian and authorize anyone under the age of 18 (“Minor”) to use the Samsung Services, you agree to: (i) monitor the minor`s use of the Samsung+ Service; (ii) assume all risks associated with the minor`s use of the Samsung Services, including the transmission of Content to and from third parties over the Internet; (iii) assume any liability arising from the minor`s use of the Samsung Services; (iv) ensure the accuracy and truthfulness of all information provided by the minor; and (v) assume responsibility for and be bound by the Samsung Services Terms of Service for minors accessing and using the Samsung Services. 4.3 In addition, the Samsung Services may contain links to third-party websites or programs that are not controlled or affiliated with Samsung, and you understand that while using the Samsung Services, you may encounter content that may be offensive, indecent, explicit, adult-directed or offensive.
In all such cases, Samsung is not responsible and hereby disclaims any and all liability for the content, offerings, terms of use or privacy policies of such websites and programs, including, but not limited to, your use of such third-party offerings. These Terms of Service (the “Samsung Services Terms”) are a binding agreement between you and Samsung that governs your use of the Samsung Services and all features and functions contained therein, as well as other related websites or online offerings, accessible via computer or mobile device or any other technology, manner or means. The Samsung Services Terms supplement the Samsung Services Terms of Service [account.samsung.com/membership/terms] (“Terms of Service”) that you have already accepted (or at the same time accept these Samsung Services Terms of Use) when you sign up for a Samsung Single Sign-On Account (the “Samsung Account”). You must have a Samsung account to access and use Samsung services. If you do not already have a Samsung Account, please read the Terms and Conditions and open a new Samsung Account before using the Samsung Services. You acknowledge and agree that the Samsung Services Terms of Service have been incorporated into the generally applicable Terms of Service. Your use of the Linked Service is solely between you and the third party and is subject to the terms of use of the applicable Linked Service providers. For the avoidance of doubt, Samsung is not responsible and hereby disclaims any liability in connection with or arising from the Linked Service, including, but not limited to, quality, performance or malfunctions. 10.3 Severability. If any provision or provision of the Samsung Services Terms of Service is determined by any judicial or administrative authority to be void or unenforceable, such decision shall not affect the validity of the enforceability of the remaining terms and provisions of the Samsung Services Terms of Service. The remaining provisions of this Agreement shall remain in full force and effect and shall be construed in accordance with its terms. You will promptly notify Samsung via email if you become aware support@mysamsung.asia of any unauthorized use of your registration or account information or any other breach of security. When you register for a Service, you may be presented with special terms that may describe, among other things, specific features of the Service and establish additional legal provisions (collectively, the “Special Terms”). 10.2 Arbitration. By using the Samsung Services, you unconditionally agree that: (i) any claim, dispute or controversy (whether in contract, tort or otherwise) you have against any Samsung company, the officers, directors, agents and employees of a Samsung company (“Samsung Companies”) arising out of, related to or in any way related to the Samsung Services; or the determination of the scope or enforceability of this provision shall be resolved only by final and binding arbitration administered by JAMS and conducted before a sole arbitrator in accordance with the rules of JAMS; (ii) This clause is made pursuant to a transaction involving interstate commerce and is governed by the Federal Arbitration Act (“FAA”), 9 U.S.C.
