Upper Law Society of Canada Complaints

Law Society staff handle most complaints by providing advice to lawyers and paralegals on client service. A small number of complaints about serious issues can lead to formal prosecution, disciplinary hearings and sanctions. During this process, the Law Society will inform you of the status and outcome of your complaint. They will tell you what happens to your complaint, including: As with other complaints, it may be helpful to speak directly to your lawyer before filing a formal complaint about your bill. Your lawyer or someone from your law firm can tell you exactly what your lawyer did in your case and how long it took. If you tell the lawyer why you think the bill is too high, your lawyer may be willing to reduce the account in some cases. If you believe your lawyer or paralegal has discriminated against you because of your race, ancestry, origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, same-sex partner status, age, marital status or disability, you must contact the Discrimination and Harassment Counsel (DHC) program. The DHC is funded by the Law Society but operates independently. All complaints to the DHC will be treated confidentially. There is no charge for DHC`s services, which include support: this can help both parties agree on bills without having to go to a formal hearing. Experienced assessment officers conduct mediation activities that can take place at any stage of the assessment hearing process. There are no additional legal fees for this service. You will attend a hearing where you can represent yourself or be represented by a lawyer.

You and your lawyer will have the opportunity to speak to the appraisal officer, who will determine if the bill is fair and reasonable. Unless the matter is very long or complex, the assessment officer`s decision is made at the hearing. The Law Society can only deal with complaints about a lawyer or licensed paralegal. The Law Society has the authority to regulate lawyers and paralegals licensed in Ontario under the Law Society Act. They can help you with questions that fall within their jurisdiction. However, they cannot help with all kinds of ailments. However, if you feel that a lawyer has charged you too much for legal services and the conversation with your lawyer did not work, you can contact the Ontario Superior Court of Justice Assessment Office. The Evaluation Office is an officer of the Ontario Superior Court of Justice. An appraisal officer will review your lawyer`s bill and determine if it is fair.
