Adjournment Law Access

If you can get to the courthouse before your hearing date, you can request an adjournment by filling out a form that you can obtain from a clerk. If the request is rejected, you will be marked as default, which can be very serious. The judge may dismiss the request for adjournment. You will be redirected to your district court`s website. Then select “Justice Offices / Departments / Family Departments”. You can find the phone number of the Domestic Violence Unit on your county`s Family Department website. Some counties allow adjournment requests to be received directly by telephone, while others ask you to fax or email in a written request. If your district requests a letter, be sure to verify the name, fax number, and address of the court staff to whose attention you should send your application. In your written request for adjournment, include the name of your case, the file number and the expected date of your trial.

Tell the court the reason for your request for an adjournment, such as illness because you are seeking advice or because your witnesses are not available. Be sure to inform the court of any date in the coming month if you are not available. Many people do not have fax machines at home, but there are places where fax machines are accessible to the public. Public libraries, post offices, and office supply stores often have fax machines that can be used for a small fee. There is also computer software that allows you to fax from your personal computer if you have a scanner. If you do not have access to a fax machine, call your county`s Domestic Violence Department and let them know that you will make a written request by mail. You can also send the written request in person. Defendants who wish to request an adjournment must contact the attorney to obtain consent to an adjournment. The defendant must then submit to the court a written request containing a reason for the request to adjourn the proceedings, as well as a statement indicating whether or not the prosecutor`s consent has been obtained. If you were unable to obtain an adjournment before your hearing date, you must apply to the court in person. Be sure to go to court on the date and time listed on the fourth page of your injunction.

If you appear in court on the day and time of your injunction, wait outside the courtroom where you were assigned. A sheriff or court clerk will check anyone who has a court that day. You should tell the court a reason for your request for an adjournment, such as hiring a lawyer because you need more time to prepare or to allow witnesses to appear. Some courts will immediately provide you with an extension order without appearing in the courtroom. Other courts may require you to appear before the judge to make your application. If you are summoned before the judge, you will have to repeat your request and the reason why you want a later hearing date. To help you plan, let the court know every day in the next few weeks when you can`t go to court. The judge will then decide whether to grant your request for an adjournment. Requests for postponement can sometimes be rejected. This can happen if there have been several changes.
